Instagram Automation Terms of Service

1. Acceptance

These Instagram Automation Terms of Service (the "Terms") govern your use of the Requex.me Instagram Automation feature (the "Feature") operated by Requex.me ("we," "us," "our"). They supplement, and are read together with, our general Terms of Service and Instagram Automation Privacy Policy. By connecting an Instagram account to Requex.me, you agree to these Terms.

2. Eligibility

• You must own, or have explicit authorization from the owner of, the Instagram business or creator account you connect.
• The connected Instagram account must comply with Instagram's Community Guidelines, Meta Platform Terms and Developer Policies, and the Instagram Messaging Policy.
• You must be at least 18 years old, or the legal age of majority in your jurisdiction.

3. Description of the Feature

The Feature lets you configure automation rules that, when triggered by a comment or direct message on your connected Instagram account, post a public reply, send a private reply to the commenter, or send a direct message — using the Instagram Graph API and the official Messenger Platform for Instagram. The Feature is provided on an "as-is" and "as-available" basis.

4. Acceptable Use

You agree not to use the Feature to:

• Send unsolicited bulk messages, promotional content, or any communication that would constitute spam under Meta's policies or applicable law (including CAN-SPAM, GDPR, ePrivacy, TCPA).
• Send a direct message outside the 24-hour standard messaging window, except as permitted by Instagram's message tags. Requex enforces this on your behalf.
• Send more than one private reply per comment, or reply to a comment more than seven (7) days after it was posted. Requex enforces this on your behalf.
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
• Distribute malware, phishing links, sexually explicit content, hate speech, violence, harassment, or content that infringes third-party intellectual property.
• Collect, store, or otherwise process information about Instagram users beyond what the Feature surfaces to you in the dashboard, or use that information for advertising, profiling, or training machine-learning models.
• Re-sell, sublicense, or expose the Feature's programmatic access (including Instagram tokens issued to Requex) to any third party.
• Attempt to circumvent rate limits, message tags, or other technical controls that Meta or Requex imposes.

5. Your Responsibilities

• You are solely responsible for the content of the response templates, DMs, images, and button URLs you configure. Requex does not pre-screen automation content.
• You are responsible for any messages sent on your behalf as a result of rules you create, including those triggered while you are offline.
• You agree to maintain valid Instagram credentials and to reconnect the account if the access token expires or is revoked.
• You agree to comply with all applicable laws of the jurisdictions where the recipients of your messages are located.

6. Credits and Billing

Each automation action consumes credits from your Requex.me account (currently: one credit per public reply, one credit per DM, two credits when a rule sends both). If your balance is exhausted, matching rules are skipped silently — no messages are sent. Credit pricing, allocation, and any paid top-up arrangements are governed by our general Terms of Service.

7. Meta Platform Compliance

The Feature integrates with the Instagram Graph API and Messenger Platform for Instagram. Your use of those services is also governed directly by Meta's applicable terms and policies. Meta may, at any time and without notice to Requex, change its APIs, revoke access, restrict permissions, or impose additional requirements. We will use commercially reasonable efforts to adapt the Feature, but we are not responsible for service interruptions caused by Meta's actions.

8. Suspension and Termination

We may suspend or terminate your access to the Feature, with or without prior notice, if:

• You violate these Terms or any of the policies referenced in Section 2.
• Meta notifies us of a violation or revokes the permissions necessary to operate the Feature on your behalf.
• Your use creates legal, regulatory, or reputational risk for Requex or its other users.

You may stop using the Feature at any time by clicking Disconnect in the Instagram Automation dashboard, which immediately revokes our access and deletes all associated automations and tokens.

9. Data Deletion

We honour data deletion requests submitted directly via Meta's Instagram settings, via the in-app Disconnect button, or by email to developer@requex.me. Full handling is described in our Instagram Automation Privacy Policy.

10. Disclaimers

The Feature is provided "as is" and "as available" without warranties of any kind, whether express or implied, including (without limitation) implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Feature will be uninterrupted, secure, or error-free. We do not warrant that automated replies will be delivered, that Meta will accept any specific message, or that webhook events will arrive within any specific time window.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Requex.me, its officers, employees, contractors, or affiliates be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including loss of revenue, loss of followers, account suspensions imposed by Meta, or loss of data — arising out of or relating to your use of the Feature, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim relating to the Feature will not exceed the greater of (a) the amount you paid us for the Feature in the twelve (12) months preceding the claim, or (b) USD 50.

12. Indemnification

You agree to indemnify, defend, and hold harmless Requex.me from and against any third-party claim, damages, liability, costs, or expenses (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) content you configured to be sent via the Feature, or (c) your violation of any law or third-party right.

13. Changes to These Terms

We may update these Terms as the Feature evolves or as Meta's requirements change. Material changes will be communicated by updating the "Effective" date above and, for substantive changes, by email or in-app notification. Continued use of the Feature after the effective date constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws specified in our general Terms of Service, without regard to conflict-of-laws principles. Any dispute arising out of or relating to the Feature will be resolved in accordance with that document.
